Evaluation-only prototype: HTS 9817.85.01 will be recommended — duty-free entry for articles used exclusively for development, testing, product evaluation, or quality control. Compliance with 19 CFR 10.91 is required — parts may not be sold or incorporated into products for sale prior to completing their use as prototypes. CBP may request proof of actual use within 3 years of entry. Confirm this classification with your customs broker before use.
Production-bound prototype: Commercial HTS code will be recommended and standard duties apply. Ensure the commercial invoice clearly describes the item as "[Part description] — Prototype/Sample" with accurate transaction value. Do not use HTS 9817.85.01 for parts intended to enter commercial production.
